Emancipation FAQs

Q. Do I need my parents permission to be emancipated?
A. Your parents will be notified of emancipation proceedings by a summons to appear at the hearing. It is recommended that you and your parents come in to speak to a Juvenile Court Counselor prior to applying for emancipation.

Q. What will happen at the court hearing?
A. The Court will want to know the following:

a) Whether the parent of the minor consents to the proposed emancipation;
b) Whether the minor has been living away from the family home and is substantially able to be self-maintained and self-supported without parental guidance and supervision;
c) Whether the minor can demonstrate to the satisfaction of the Court that the minor is sufficiently mature and knowledgeable to manage the minor's affairs without parental assistance.

Q. Can I purchase alcohol or cigarettes once I am emancipated?
A. No, you are still a minor.

Q. Do I need to have a job to get emancipated?
A. You will need to prove to the Court that you have the means to support yourself without the help of your parents. You will need to have a plan in place that supports your education and finances.

Q. Is there any cost to be emancipated?
A. Yes. There is a $162.oo filing fee. This is paid to the Wasco County Circuit Court at the time the Application for Decree of Emancipation is filed. This is non-refundable, even if emancipation is denied.

Q. If I am emancipated in Oregon and move out of State, am I still considered emancipated in that State?
A. That depends on what State you are moving to.
